Terms of Service

We do not share or sell your health data

  • No third-party sharing. Your check-ins, treatments, notes, and survey answers are not sold, licensed, traded, or otherwise disclosed to researchers, pharmaceutical companies, advertisers, data brokers, analytics vendors, or artificial-intelligence providers.
  • No advertising. The app contains no advertising and performs no ad targeting or profiling of any kind.
  • No AI processing of your entries. Your health entries are never sent to an AI model or AI gateway.
  • No admin browsing of your health record. CLA administrators cannot open an individual patient’s check-ins, notes, or treatments. They see only account and activity information needed to support you, plus aggregate counts used to run the program.
  • You control what leaves the app. You generate your own Discussion Guide and decide whether to print, download, or show it to your clinician. CLA does not send it anywhere on your behalf.
  • Aggregate program metrics only. CLA reviews internal totals and averages (for example, how many people checked in this week) to operate and fund the program. These are counts, never individual records, and are not published or provided to outside organizations as patient data.

Limited exceptions: service providers strictly needed to run the app (hosting, database, authentication, email delivery) process data under contract on CLA’s instructions, and CLA may disclose data if legally compelled or to address a safety emergency.

Please read carefully. By creating an account or using the PBC Itch Tracker & Discussion Guide (the “App”), you agree to these Terms of Service and the Data Privacy Policy. If you do not agree, do not create an account and do not use the App.

1. What the App is (and is not)

The App is a free, patient-facing tool provided by the Community Liver Alliance (“CLA”), a 501(c)(3) nonprofit. It helps people living with Primary Biliary Cholangitis (PBC) track itch and related symptoms, generate discussion prompts for their care team, and read plain-language educational content.

The App is not a medical device. It does not diagnose, treat, cure, monitor, mitigate, or prevent any disease. It is not a substitute for professional medical advice, diagnosis, or treatment.

Not an emergency service. If you think you are having a medical emergency, call your local emergency number or go to the nearest emergency department immediately.

2. Eligibility

  • You are 18 years of age or older.
  • You are a resident of the United States.
  • You are using the App for your own personal, non-commercial tracking.

3. Your consents

Before you can use the App you confirm your age and residency, acknowledge that the App does not provide medical advice, and consent to CLA storing the health information you enter for the sole purpose of operating the tracker for you. There is no research consent, advertising consent, or AI consent, because the App does none of those things.

4. HIPAA does not apply; other laws do

CLA is not a HIPAA-covered entity. Information you enter is consumer health data under state law and is governed by our Consumer Health Data Policy.

5. How the App works and what is collected

You record check-ins, treatments, and notes; the App shows your history, trends, and a printable Discussion Guide. Optional features include reminder emails and weather capture, which uses an approximate location to retrieve environmental conditions without storing your coordinates on your check-ins. In-app insights (for example, your most frequently logged trigger) are rule-based statistics computed from your own entries inside the App — no AI model or external service is involved, and they are not medical advice.

6. Sharing of your data

CLA does not sell your data and does not share your health entries with researchers, pharmaceutical companies, sponsors, advertisers, data brokers, or AI providers. The only outward sharing is the Discussion Guide that you choose to print, download, or show to your clinician.

7. Your responsibilities

  • Keep your sign-in credentials secure and do not share your account.
  • Enter accurate information, and avoid typing names, addresses, phone numbers, or other identifying details of yourself or others into free-text fields.
  • Do not attempt to access another user’s data, scrape the App, or interfere with its operation.
  • Continue to follow your clinician’s guidance; never change treatment based on what you see in the App.

8. Educational content

Articles are general information, may not reflect the latest research, and are not personalized medical advice.

9. Third-party services and links

The App relies on service providers for hosting, authentication, email, and public weather data. Links to outside resources are provided for convenience; CLA is not responsible for their content or practices.

10. Account termination

You may delete your account at any time from Settings. CLA may suspend accounts that violate these Terms or threaten the security of the App.

11. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, CLA is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

13. Changes to these Terms

We will notify you in the App before material changes take effect. Continued use after that constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
